Wrongful Death

A lawsuit filed for wrongful death claims that the victim was killed as a result of negligence or unjust act by the individual or entity being sued. It also claims that the victim’s survivors are entitled to monetary damages as a result of such negligence or act.

All states have some form of a wrongful death claim action in force. Each state’s statutes are different, however, they all share common factors:

• The victim’s death was caused by the actions of the one being sued
• The one being sued is liable for the victim’s death
• There are surviving immediate family members
   (spouse, children, dependents, etc.)
• Monetary damages are awarded as a result of the victim’s death
