Defective Products

There are product liability laws in place that govern the responsibility of manufacturers, wholesalers, distributors and vendors for damages caused by defective and dangerous products. These laws help protect consumers from dangerous products while holding responsible parties accountable to producing and marketing products that they knew or should have known to be defective or dangerous. These laws can pertain to any type of product in any industry.

If you have been harmed by a dangerous or defective product, you may be entitled to compensation. Please give us a call or fill out or form online to schedule a consultation.

Pharmaceuticals

Drug recalls are becoming more and more prevalent. If someone is injured from a pharmaceutical drug they used, that may be grounds for a defective products claim. These claims can come in the form of individual or class action suits. There are three types of pharmaceutical claims:

1. Defective manufacturing of a pharmaceutical drug
2. Dangerous side effects of a pharmaceutical drug
3. Improperly marketed pharmaceutical drug

It is possible that a combination of claims may apply to a specific situation. If you have taken a pharmaceutical drug that has been recalled, you may be entitled to compensation. Please give us a call or fill out our form online to schedule a consultation.

Children’s Toys

Defective products are a major cause of injuries among children. In 2009, 5.3 million toys and other children’s products were pulled from store shelves due to choking hazards alone. Another 1.3 million toys or other children’s products were recalled by the Consumer Product Safety Commission for violations of the lead paint standard.

When a children’s product is found to be defective and it causes serious injuries, the manufacturer can be held liable. Parents should be careful when choosing toys for their children by making sure it is age appropriate and in good condition. Even when safety precautions are taken, it is impossible to anticipate problems that may arise when a toy or product is defective. There are toys and products recalled almost weekly. Parents and caregivers can stay updated on the latest recalled toys and children’s products by signing up to receive emails from the U.S. Consumer Product Safety Commission at www.cpsc.gov.
Safety testing on children’s toys and products is inadequate. Often, the anufacturers are reluctant to recall a product until there have been injuries and even deaths. Even then, recalls are often not communicated effectively, leaving families vulnerable to further danger. If your child has been injured by a defective toy or product, you may be entitled to compensation. Please give us a call or fill out our form online to schedule a consultation.
